1. Introduction

Welcome to Care Train.

These Terms of Use ("Terms") govern your access to and use of the Care Train platform, website, applications, services and related features.

2. About Care Train

Care Train is a healthcare education marketplace that connects:

  • Healthcare professionals;
  • Employers;
  • Training providers;
  • Education organisations;
  • Event organisers;
  • Industry partners.

The platform enables users to discover, promote, purchase and manage healthcare education opportunities, including:

  • Conferences;
  • Workshops;
  • Webinars;
  • Training programs;
  • Professional development activities;
  • Continuing Professional Development (CPD) opportunities.

Care Train provides technology infrastructure and marketplace services.

Unless expressly stated otherwise, Care Train does not provide the training, education, accreditation or professional services listed by third parties.

3. Definitions

In these Terms:

Attendee means a person who registers for or purchases access to an event, course or activity.

Organiser means any person, business or organisation listing or delivering an event, course or education activity.

Platform means the Care Train website, applications and associated services.

Content means any information, text, images, videos, documents, logos, reviews or materials uploaded to the Platform.

Services means all services provided by Care Train.

4. Eligibility and Account Registration

To use certain Care Train features, you may be required to create an account.

You agree that:

  • Information provided is accurate and current;
  • You will maintain confidentiality of your login details;
  • You will not share your account with another person;
  • You are responsible for all activity conducted through your account.

Care Train may suspend or terminate accounts where we reasonably believe there is:

  • Fraudulent activity;
  • Misuse of the platform;
  • Breach of these Terms;
  • Unlawful behaviour;
  • Risk to other users or the platform.

5. Use of the Platform

You agree to use Care Train only for lawful purposes.

You must not:

  • Provide false or misleading information;
  • Upload unlawful, defamatory or harmful content;
  • Attempt to gain unauthorised access;
  • Interfere with platform operation;
  • Copy, reproduce or exploit Care Train content without permission;
  • Use the platform for spam or unauthorised marketing;
  • Misrepresent qualifications, registrations or professional credentials.

6. Healthcare Education Disclaimer

Care Train provides access to education opportunities but does not guarantee:

  • The accuracy of event information;
  • The quality of education delivered;
  • The qualifications of trainers;
  • The suitability of courses;
  • Professional registration acceptance;
  • CPD recognition by regulators or professional bodies.

Users are responsible for confirming whether an education activity satisfies their professional requirements.

Care Train does not provide medical, clinical, legal or professional advice.

7. Event Organiser Responsibilities

Organisers are solely responsible for events, courses and educational activities listed on Care Train.

Organisers must ensure:

  • Event information is accurate;
  • Pricing information is correct;
  • They have authority to provide the training;
  • They hold required licences, approvals or permissions;
  • CPD claims are accurate;
  • Content complies with applicable laws;
  • Refund and cancellation policies are clearly communicated;
  • Attendees receive appropriate information.

Care Train may remove or restrict listings where we reasonably believe information is inaccurate, misleading, unlawful or harmful.

8. Event Listings and Content

Organisers are responsible for all content submitted to Care Train.

By submitting content, you confirm that:

  • You own or have permission to use the content;
  • The content does not infringe third-party rights;
  • The information is accurate.

You grant Care Train a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and promote submitted content for:

  • Operating the platform;
  • Marketing Care Train;
  • Promoting listed events;
  • Improving user experience.

9. Ticket Purchases and Payments

Care Train may facilitate ticket transactions between attendees and organisers.

Payment processing may be provided through third-party payment providers.

Unless otherwise stated:

  • Payments are processed electronically;
  • Funds may be transferred directly to organisers at the time of purchase;
  • Care Train does not hold attendee funds;
  • Care Train does not guarantee organiser performance.

Care Train is not responsible for:

  • Organiser refunds;
  • Event cancellations;
  • Organiser insolvency;
  • Failure to deliver services purchased.

10. Refunds and Cancellations

Refunds, transfers and cancellations are generally managed by the relevant organiser.

Each organiser is responsible for publishing clear refund and cancellation policies.

Nothing in these Terms removes rights available to consumers under the Australian Consumer Law.

Where required by law, Care Train will assist users in communicating with organisers regarding disputes.

11. Fees and Charges

Care Train may charge:

  • Platform fees;
  • Service fees;
  • Subscription fees;
  • Promotional fees;
  • Transaction fees.

Applicable fees may be displayed before acceptance.

Care Train reserves the right to update pricing with reasonable notice.

12. Reviews and User Feedback

Users may provide reviews, ratings or feedback.

You agree that reviews must:

  • Be truthful;
  • Relate to genuine experiences;
  • Not contain unlawful or defamatory material.

Care Train may remove content that:

  • Breaches these Terms;
  • Is misleading;
  • Violates another person's rights;
  • Creates legal risk.

13. Intellectual Property

All intellectual property rights in Care Train, including:

  • Website design;
  • Software;
  • Branding;
  • Logos;
  • Content;
  • Systems;
  • Databases;
  • Technology,

remain the property of Care Train or its licensors.

You must not reproduce, modify, distribute or commercially exploit Care Train materials without written permission.

14. Third-Party Services

Care Train may integrate with third-party services including:

  • Payment providers;

  • External registration systems.

Care Train does not control and is not responsible for:

  • Third-party availability;

16. Artificial Intelligence and Recommendations

Care Train may use artificial intelligence and automated technologies to:

  • Enhance platform functionality.

AI-generated recommendations are provided as assistance only.

Users remain responsible for their own decisions regarding education, training and professional development.

17. Suspension and Termination

Care Train may suspend or terminate access where:

  • These Terms are breached;
  • The platform is misused;
  • Fraud is suspected;
  • Legal obligations require action;
  • User behaviour creates risk.

Termination does not affect rights or obligations accrued before termination.

18. Limitation of Liability

To the maximum extent permitted by law, Care Train is not responsible for:

  • Third-party events;
  • Organiser conduct;
  • Training outcomes;
  • CPD acceptance decisions;
  • Loss caused by third-party services;
  • Technical interruptions outside our reasonable control.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded under Australian Consumer Law.

19. Indemnity

You agree to indemnify Care Train, its directors, employees, contractors and service providers against claims, losses, damages or expenses arising from:

  • Your breach of these Terms;
  • Your misuse of the platform;
  • Your submitted content;
  • Your unlawful conduct;
  • Your breach of third-party rights.

20. Changes to These Terms

Care Train may update these Terms from time to time.

Updated Terms will be published on the Care Train website.

Your continued use of the platform after changes are published constitutes acceptance of the updated Terms.

21. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You agree to submit to the jurisdiction of Victorian courts.
