Care Train — Terms and Conditions of Use

1. About these Terms

These Terms and Conditions ("Terms") govern your access to and use of the Care Train platform at [website URL] (the "Platform"), operated by [legal entity name] (ABN [ABN]) ("Care Train", "we", "us", "our").

By creating an account, listing an event, making a booking, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.


2. Definitions

  • Attendee / User — anyone who uses the Platform, including to browse or book events.
  • Organiser — a person or organisation that lists an event or course on the Platform.
  • Employer — an organisation that books or enrols staff onto events.
  • Listing — an event, conference, course, or training session published on the Platform.
  • Aggregated listing — a listing compiled from publicly available third-party sources

rather than submitted by the organiser (see section 8).

  • CPD — continuing professional development.

3. Eligibility and accounts

  • You must be at least 18 years old and able to form a binding contract to use the Platform.
  • You are responsible for the accuracy of the information you provide and for keeping your

login credentials secure. You are responsible for activity that occurs under your account.

  • Notify us promptly at [support email] of any unauthorised use of your account.
  • We may suspend or terminate accounts that breach these Terms (see section 16).

4. Our role — a marketplace intermediary

Care Train is a marketplace and booking platform. Except where we are expressly named as the organiser, we do not run, host, or deliver the events listed on the Platform. The contract for attendance at an event is between you and the relevant Organiser.

We are not responsible for the content, quality, safety, legality, accuracy, delivery, or cancellation of any event, nor for an Organiser's or Attendee's conduct. We do not guarantee that any event will take place, meet your expectations, or deliver any particular CPD or professional outcome.


5. Listings by organisers

Organisers are solely responsible for their Listings, including the accuracy of event details, pricing, capacity, CPD information, and for delivering the event as described. By publishing a Listing, an Organiser warrants that:

  • the information is accurate and not misleading;
  • they have the right and any necessary accreditation to run the event;
  • the Listing and event comply with all applicable laws; and
  • they will honour bookings made through the Platform and handle attendee data lawfully.

We may edit, refuse, or remove any Listing at our discretion, including where it breaches these Terms.


6. Bookings, tickets, pricing, and fees

  • Prices are shown in Australian dollars (AUD) and, where applicable, include GST.

A tax invoice is provided for paid bookings.

  • When you book a paid event, you authorise the charge for the ticket price plus any

disclosed fees. Payments are processed by our third-party payment processor ([e.g. Stripe]); by paying, you also agree to that processor's terms.

  • Care Train may charge Organisers a service fee on paid ticket sales, and may charge or

pass on payment-processing costs. Applicable fees are disclosed before purchase or in the Organiser terms.

  • A booking is confirmed only when you receive a confirmation from the Platform.
  • Free events may be booked without payment; capacity and eligibility conditions set by the

Organiser still apply.


7. Cancellations, changes, and refunds

  • Refund and cancellation policies are set by each Organiser and shown on the Listing or

at checkout. Refund requests for a specific event should generally be directed to the Organiser.

  • If an Organiser cancels or materially changes an event, the Organiser is responsible for

refunds in line with their policy and applicable law.

  • Nothing in these Terms limits your rights under the Australian Consumer Law, including

any right to a remedy where services are not delivered with due care and skill or do not match their description.

  • Care Train may, at its discretion, assist in resolving disputes but is not obliged to

provide refunds for events it does not itself run.


8. Aggregated and third-party listings — important disclaimer

To help you discover relevant events, the Platform may display aggregated listings compiled from publicly available third-party sources (such as event-ticketing sites, professional bodies, training providers, and public web pages) rather than submitted by the Organiser. In relation to aggregated listings, you acknowledge and agree that:

  • They are provided "as is" for information only. Details (including dates, times,

pricing, availability, and CPD hours) are drawn from external sources and may be inaccurate, incomplete, out of date, or changed by the Organiser without notice.

  • We do not verify, endorse, or guarantee aggregated listings, the events they describe,

or the Organisers who run them, and inclusion does not imply any affiliation with, sponsorship by, or approval of Care Train.

  • You should confirm all details with the original source or Organiser (via the source

link provided) before relying on them, making travel arrangements, or making a booking.

  • Where booking or payment for an aggregated event occurs on a third-party website, that

transaction is governed by that third party's terms and privacy policy, not ours, and we are not a party to it.

  • We are not liable for any loss or inconvenience arising from reliance on an aggregated

listing, to the maximum extent permitted by law (see section 11).

  • We aim to attribute sources and to rely on official APIs, feeds, and permitted public

information. If you are an Organiser and wish to claim, correct, or request removal of an aggregated listing about your event, contact us at [support email] and we will action reasonable requests promptly.


9. CPD hours and certificates

Any CPD hours, points, or certificates shown or issued through the Platform are provided as a record of attendance or completion as stated by the Organiser or source. Care Train is not a registration, accreditation, or regulatory authority and does not certify or guarantee that any event, CPD amount, or certificate will be accepted by AHPRA, a National Board, an RTO, an employer, or any other body. You are responsible for confirming that an activity meets your own professional development requirements.


10. Acceptable use

You agree not to:

  • provide false, misleading, or fraudulent information;
  • use the Platform for any unlawful purpose or in breach of these Terms;
  • post content that is defamatory, infringing, discriminatory, harmful, or misleading;
  • interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its

systems;

  • scrape, harvest, or copy Platform content except as expressly permitted; or
  • impersonate any person or misrepresent your affiliation with any person or organisation.

We may investigate and take action, including removing content and suspending accounts, for suspected breaches.


11. Disclaimers and limitation of liability

  • The Platform and its content are provided "as is" and "as available". To the

maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms.

  • Australian Consumer Law: Certain rights and guarantees (consumer guarantees) cannot be

excluded. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited (at our option) to resupplying the relevant service or paying the cost of having it resupplied.

  • Subject to the above, to the maximum extent permitted by law, Care Train is not liable

for any indirect, incidental, special, or consequential loss, loss of profits or data, or for any loss arising from: (a) an event listed by an Organiser; (b) reliance on an aggregated or third-party listing; (c) the acts or omissions of any Organiser, Employer, Attendee, or third party; or (d) any interruption or unavailability of the Platform.


12. Indemnity

To the extent permitted by law, you agree to indemnify Care Train against any claims, loss, damage, or costs arising from your breach of these Terms, your misuse of the Platform, or — if you are an Organiser — from your Listings or events.


13. Intellectual property

The Platform, including its design, logo, branding, and content we create, is owned by or licensed to Care Train and protected by law. You may not copy, reproduce, or use it except as permitted by these Terms. Content you submit (such as Listings or reviews) remains yours, but you grant Care Train a non-exclusive, royalty-free licence to host, display, and promote it for the operation of the Platform.


14. Third-party links

The Platform may contain links to third-party websites (including the sources of aggregated listings). We are not responsible for the content, products, or practices of those sites, and accessing them is at your own risk.


15. Privacy

Our handling of personal information is described in the Care Train Privacy Policy, which forms part of these Terms.


16. Suspension and termination

We may suspend or terminate your access to the Platform, with or without notice, if you breach these Terms, if required by law, or to protect the Platform or other users. You may close your account at any time. Provisions that by their nature should survive termination (including sections 11, 12, and 13) will continue to apply.


17. Changes to these Terms

We may update these Terms from time to time. The current version will be available on the Platform with the "Last updated" date shown above. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.


18. Governing law

These Terms are governed by the laws of [insert State/Territory, e.g. New South Wales], Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
